- Smith was suspended from exercising executive authority by a resolution of the General Council of the Provisional Government of Texas approved on 11 Jan 1836. The functions of Governor devolved on the Lieutenant Governor who took the oath of office as Acting Governor on the same day:

- Following the passing of the resolution, suspeding Smith from office, he was informed of the decision and refused to comply. Both Smith and Robinson exercised their functions until the meeting of the Convention on 1 Mar 1836.
