In his proclamation of 22 Aug 1846, Kearny claimed New Mexico by right of conquest and declared that he should "be considered as governor of the Territory," although he did not formally assume that style.
Following the assassination of Governor Bent, the functions of the office devolved upon Secretary of the Territory Vigil, who issued a proclamation to that effect on 25 Jan 1847.
Following the adoption of the Constitution of the State of New Mexico on 25 May 1850, Munroe complied with the request of the Constitutional Convention to call an election under the Constitution. The vote was duly held, resulting in the election of Henry Connelly and Manuel Álvarez as Governor and Lieutenant Governor. As Connelly was absent from New Mexico, Álvarez claimed the right to assume office as Acting Governor, but Munroe refused to transfer executive authority to the elected officials.
