At the moment of death of Sidónio Pais (at 23:55 14 Dec 1918 according to official information), the constitutional situation in Portugal was ambiguous. The Constituion of 1911 was not abrogated, but its provisions were de facto superseded by extraordinary legislation. The Government of the Republic which held a meeting 15 Dec 1918 resolved that it had assumed the executive authority in accordance with Paragraph 3, Art. 38 of the Constitution, thus notionally acting as collective Head of State from 23:55 14 Dec 1918. In violation of the constitutional provisions, the Government elected João do Canto e Castro as its president and proceeded with enactment of certain decrees. The Câmara dos Deputados (Chamber of Deputies) and Senado held separate meetings (15:00-18:15 16 Dec 1918 and 14:20-18:25 16 Dec 1918 respectively) and enacted legislation (Lei n.° 833) that a) restored the articles of the Constitution of 1911 concerning the office of Presidente da República, and b) assigned "current ministers or secretaries of state" (os actuais Ministros ou Secretários de Estado) under the presidency of Canto e Castro to exercise the duties of President of the Republic until his swearing-in:

Artigo 1.° São suspensos, até à revisão constitucional determinada no artigo 2.º as disposições transitórias do decreto n.º 3:996, de 30 de Março de 1918, os artigos 116.º a 121.º, inclusive, deste decreto.

§ único – Até a revisão constitucional considera-se em pleno vigor a Constituição Política de 1911, na parte alterada pelos referidos artigos.

Art. 2.° O Presidente da República a eleger desde já, nos termos do § 2.º do artigo 38.º da Constituição Política, exercerá o cargo até à posse do Presidente da República que for eleito se harmonia com o novo Estatuto Constitucional.

§ único – A inelegibilidade estabelecida no artigo 50.º da Constituição é suspensa para a eleição a realizar desde já.

Art. 3.° Até a posse do Presidente da República, que o Congresso vai eleger, conforme o citado artigo 38.º, §§ 2.º e 3.º, são mantidos na plenitude do Poder Executivo os actuais Ministros ou Secretários de Estado, sob a Presidência do Ministro da Marinha e interino dos Negócios Estrangeiros, Sr. Almirante João do Canto e Castro Silva Antunes.
