The Mesilla Convention did not pass a secession ordinance, but adopted a declaration stating that the people of Arizona "will not recognise the present Black Republican Administration" and that it is their "earnest desire to be attached to (the) Confederacy as a Territory."

Following the occupation of Tucson, the commander of the First California Volunteers, James H. Carleton, proclaimed the creation of the Territory of Arizona, asserting that the Congress of the United States had "set apart a portion of New Mexico and organized it into a Territory complete in itself," although no act to that effect had been passed prior to 8 Jun 1862.
