In accordance with Art. 64 (1) of the Constitution of the Republic of Austria (Bundes-Verfassungsgesetz) [1], the functions of the Bundespräsident in case of vacancy in the office are provisionally exercised by the Kollegium (in full: Das mit der Ausübung der Funktion des Bundespräsidenten betraute Kollegium), consisting of three presidents of the Nationalrat. The office of Bundespräsident remained vacant in the period between the death of Thomas Klestil (6 Jul 2004) and the day (8 Jul 2004) when Heinz Fischer took the oath of office as a new Bundespräsident. In accordance with Article 57, the Kollegium was set up and included Andreas Khol (Präsident des Nationalrates, President of the Nationalrat from 20 Dec 2002), Barbara Prammer (Zweite Präsidentin des Nationalrates, Second President of the Nationalrat from 16 Jun 2004), and Thomas Prinzhorn (Dritter Präsident des Nationalrates, Third President of the Nationalrat from 20 Dec 2002). The chairmanship of the Kollegium and its public representation devolved on Andreas Khol as the President of the Nationalrat.

Artikel 64.

(1) Wenn der Bundespräsident verhindert ist, gehen alle seine Funktionen zunächst auf den Bundeskanzler über. Dauert die Verhinderung jedoch länger als 20 Tage, oder ist der Bundespräsident gemäß Art. 60 Abs. 6 an der ferneren Ausübung seines Amtes verhindert, so üben der Präsident, der zweite Präsident und der dritte Präsident des Nationalrates als Kollegium die Funktionen des Bundespräsidenten aus. Das gleiche gilt, wenn die Stelle des Bundespräsidenten dauernd erledigt ist.

(2) Das nach Abs. 1 mit der Ausübung der Funktion des Bundespräsidenten betraute Kollegium entscheidet mit Stimmenmehrheit. Der Vorsitz im Kollegium obliegt dem Präsidenten des Nationalrates, ebenso dessen Vertretung in der Öffentlichkeit.
